Terms and Conditions of Service

This is a translation. The legally binding version is the Spanish original, Términos y Condiciones. In the event of any discrepancy, the Spanish text prevails.

1. Object of the Contract

These terms regulate the “Website as a Service” provided by Yatoday, S.L. (The Provider) to the Client. The service includes the design, development, hosting, and maintenance of a website in exchange for a monthly subscription fee.

2. Pricing and Payment Terms

  • Setup Fee: A one-time payment of 199€ (+ VAT/IVA if applicable) is required to start the project.
  • Monthly Subscription: A fee of 39€/month (+ VAT/IVA if applicable).
  • Payment Method: Payments are processed automatically via credit card (Stripe) or direct debit at the beginning of each month.

3. Duration and Permanence

  • Minimum Contract Period: The contract has a mandatory duration of 12 months from the launch of the website.
  • Early Cancellation Penalty: If the Client cancels the service before the end of the 12-month period, a penalty fee equal to 50% of the remaining monthly installments will be charged.
  • Renewal: After 12 months, the contract automatically renews on a month-to-month basis and can be cancelled with 30 days’ notice.

4. Intellectual Property

  • Client Content: The Client retains full ownership of all texts, images, logos, and domain names provided to Yatoday, S.L.
  • Agency Technology: The website code, design structure, templates, and technical infrastructure remain the property of Yatoday, S.L.. The Client is granted a license to use the website as long as the subscription is active.
  • Buyout Option: If the Client wishes to obtain full ownership of the source code and move the site to another provider, a buyout fee of 490€ applies.

5. Service Level Agreement (SLA)

  • Development Time: The website will be ready within 4 business days after receiving all necessary content from the Client.
  • Maintenance & Edits: The subscription includes up to 1 hour of content updates per month (text/image changes). New pages or features are billed separately at 40€/hour.

6. Non-Payment

If a monthly payment fails, services will be temporarily suspended after 7 days. If payment is not received within 30 days, the website and all data may be permanently deleted from our servers.

7. Jurisdiction

These terms are governed by Spanish law. For any dispute, both parties submit to the courts of Alicante, Spain.

8. Language of this document

This document is published in Spanish, English and Russian — the three languages in which this website is offered — so that you can read it in your own (Art. 12(1) GDPR).

The Spanish version is the only prevailing version. The English and Russian versions are translations provided for your understanding; in the event of any discrepancy between them, the Spanish text prevails, as it is the language of the controller, of the contract and of the competent supervisory authority.

All prices are in euros and do not include VAT. In the case of prepayment, prices and offers will be valid for 7 days from the order confirmation; Subsequently, they will be subject to changes.

1 Production times may be extended under certain circumstances (e.g., special design, company vacation period, etc.). Please keep this in mind. This does not give you the right to demand changes to contractual prices or the possibility of terminating the sales contract.
